Removing a trustee is a delicate issue and needs to be handled by an experienced attorney. The court can remove a trustee and appoint a Successor if it determines the Trustee has breached his or her fiduciary duty as a trustee. You need to act quickly though because time limits do apply.
Examples of breaches of fiduciary duty by a trustee include stealing trust assets, failing to pay bills, failing to administer the trust and distribute the assets as required by the trust document, failing to keep the trust beneficiaries informed, and/or treating the beneficiaries (or creditors) unfairly.
