Removing a trustee is a delicate issue and needs to be handled by an experienced attorney.  The court can remove a trustee and appoint a Successor if it determines the Trustee has breached his or her fiduciary duty as a trustee.  You need to act quickly though because time limits do apply.

Examples of breaches of fiduciary duty by a trustee include stealing trust assets, failing to pay bills, failing to administer the trust and distribute the assets as required by the trust document, failing to keep the trust beneficiaries informed, and/or treating the beneficiaries (or creditors) unfairly.

In many cases, time is of the essence to protect your loved one’s legacy. We can help you to:

  • Obtain an accounting
  • Obtain copies of relevant documents, such as the trust and account statements
  • Obtain a court order for the Trustee to take certain action, such as providing an accounting, or returning assets that were wrongfully taken
  • Have the court remove the Trustee and appoint a Successor Trustee if there is sufficient evidence of trustee misconduct
  • Have the court issue any other order that may be appropriate in your particular circumstances
